There is a lot of worry and fear in our Latino community over the

At his office on 19th and Douglas, VandenBosch explained that before this when immigration (ICE) agents arrived at a location to arrest someone with a warrant, they would only take said person.

But since early 2017, media outlets have informed that said agents would arrive at workplaces and would take all undocumented employees even if they didn’t have an arrest warrant: “This happens because the definition of what was considered as a crime in these cases was broadened.”

“Rumors such as this one are spread on social media networks such as Facebook, and people get scared and don’t want to go to work, take their kids to school or go to court when they have to,” added Vanden Bosch.

Because of this, it is important that those affected by this know their rights, in case ICE happens to show up at their house: “My advice as a lawyer that you don’t open the door because you’re not required to let them in. You have to talk to your children about it because sometimes they use threats to get in and that’s when problems begin for a family.”

If ICE agents contact you for an interview, “you must remember that you have the right to remain silent and not answer any questions, especially if there isn’t a lawyer present.”

VandenBosch has over a decade of experience in his field, focusing at first on family cases, divorces and child custody hearings, but lately he has also taken on immigration cases: “For eight years I worked alone, but for the last 14 months I have partnered with Lawyer David Reed, and we opened our office in downtown Omaha where we work with another four lawyers, three of which speak Spanish.”

Cases such as child support and protection orders are some of those frequently seen at VandenBosch & Reed: “Our firm expanded so that we could help people on criminal defense cases that go from traffic tickets to felonies, as well as helping those who are in bankruptcy so that they can lower their debt or eliminate it so that they can start over.”

VandenBosch has a one hour slot on live radio every Monday at 10 a.m. at “El Show del Cachorro” with Lobo 97.7 FM radio announcer Edgar Monsivais: “People can call the station or send s text message with their questions (402.594.3955) so that I can provide them with legal advice, except on the first Monday of the month.”

He also participates at public spaces such as the South Omaha YMCA to talk about topics related to immigration: “We have published on Paisano magazine a list of all the rights of an immigrant which people should definitely check.”

VandenBosch recommends that immigrant parents who have not legalized their status and who have kids who minors should grant a power of attorney in which they state who would get the custody of their children in case they are arrested and later deported: “It is about giving someone you trust like a sister or the kids grandmother, to give them the responsibility of acting without having the State Government intervene, so that they can get together in their country of origin of they wish to do so.”

As for the young people who are taking part of the Deferred Action for Childhood Arrivals (DACA), VandenBosch emphasized that they “mist protect their status, keeping it perfect and with no blemishes because we have seen that the President is very much willing to pass a law to probably solve their situation.”

En su despacho de las calles 19 y Douglas, VandenBosch explicó que anteriormente,
cuando los agentes del servicio de inmigración (ICE) llegaban a un sitio para detener a alguien que tuviera una orden de arresto, se llevaban únicamente a ésa persona.

Pero desde principios del 2017 los medios han informado que dichos agentes acuden a centros de trabajo y se llevan a empleados indocumentados aunque no tengan una orden de arresto en su contra: “Esto sucede a consecuencia de que se amplió la definición de lo que se consideraba como un crimen en estos casos”.

“En canales sociales como Facebook se difunde tal rumor y la gente se atemoriza y no quiere salir al trabajo, llevar a sus niños a la escuela o ir a la corte cuando le toca presentarse”,  agregó VandenBosch.

Es por ello que es importante que la población afectada conozca sus derechos, por si ICE llegara a presentarse en la puerta de su casa: “Mi consejo como abogado es que no les abran ya que no están obligados a dejarlos entrar a su hogar. Es necesario hablar con los niños al respecto porque a veces con amenazas consiguen ingresar y ahí comienzan los problemas de la familia”.

Y si los agentes de ICE establecen contacto con usted para entrevistarlo, “acuérdese que tiene el derecho de quedarse callado y no responder a sus preguntas, sobre todo, si no está un abogado presente”.

VandenBosch tiene una década de experiencia ejerciendo su profesión que al principio se enfocaba en casos familiares, de divorcio y custodia de menores, pero que últimamente ha crecido considerablemente en el área de inmigración: “Durante ocho años estuve trabajando solo pero desde hace 14 meses me asocié con el abogado David Reed y abrimos nuestra oficina en el downtown de Omaha, donde además colaboran otros cuatro abogados de los cuales tres de ellos hablan español”.

Casos como el pago de pensiones para manutención de menores y órdenes de
protección, se ven comúnmente en la oficina de VandenBosch & Reed: “Nuestra firma se expandió para poder ayudar a la gente en casos de defensa criminal que van desde una multa de tránsito hasta una felonía y además apoyar a quienes están en bancarrota ya sea para reducir sus deudas o eliminarlas y así darles la oportunidad de empezar de nuevo”.

VandenBosch tiene un espacio radiofónico de una hora en vivo todos los lunes a las 10am en “El Show del Cachorro” con el locutor de Lobo 97.7 FM, Edgar Monsiváis: “Con excepción de cada lunes primero del mes, las personas pueden llamar a la estación o mandar sus preguntas a la línea de textos (402.594.3955) para que yo pueda darles una orientación legal”.

El abogado igualmente se presenta en diferentes espacios públicos como el YMCA del sur de Omaha para discutir temas relacionados con inmigración: “En la revista Paisano hemos publicado una lista de los derechos de los inmigrantes que es bueno revisar”.

En ése sentido, VandenBosch recomienda que los padres inmigrantes que no han legalizado su estatus y que tienen hijos menores de edad, hagan una carta poder donde dejen estipulado a quién le otorgarán la custodia de sus niños en caso
de que ellos sean detenidos y posteriormente deportados: “Se trata de darle la responsabilidad a alguien de confianza como a una hermana o a la abuelita, para poder actuar sin que el estado intervenga y tome otras medidas, y que así se
puedan reunir en su país de origen si lo desean”.

Por último, al respecto de los jóvenes que participan en la Acción Diferida (DACA),
VandenBosch enfatizó que “deben proteger su estatus, manteniéndolo perfecto y sin faltas, porque ya vimos que la presidencia está en buena disposición de pasar una ley para probablemente resolver su situación”.
